The Legally Binding User Agreement & Operational Charter for BR DOT HUB

Important Legal Notice (महत्वपूर्ण कानूनी सूचना): Please read these Master Terms & Conditions ("Terms", "Agreement") carefully before accessing or using BR DOT HUB (https://www.brdothub.in). This document sets forth the step-by-step operational rules, user rights, intellectual property protections, CBT examination standards, AI usage boundaries, and dispute resolution procedures governing your use of our platform.

📖 Section 1: Definitions & Legal Interpretation (परिभाषाएं और व्याख्या)

1.1 "Platform" refers comprehensively to the BR DOT HUB website (https://www.brdothub.in), its Progressive Web Application (PWA), Computer-Based Test (CBT) simulation engines, live gamified quiz modules, integrated Artificial Intelligence ("Ask AI") features, Service Workers, APIs, and all associated digital infrastructure.

1.2 "User", "You", "Your", "Candidate", or "Student" means any natural person or entity, whether registered via a local profile or browsing as an unregistered visitor, domestic or international, who accesses, loads, caches, interacts with, or utilizes the Platform for educational, preparatory, or analytical purposes.

1.3 "Organization", "Company", "We", "Us", or "Our" refers exclusively to BR DOT HUB, its sole founder, lead developer, and chief compliance officer (Niraj Kumar), administrators, and authorized legal representatives headquartered in Biharsharif, Nalanda District, Bihar, India (PIN: 803101).

1.4 "Content" encompasses all proprietary text, bilingual study notes (Markdown .md files), CBT mock test question banks, detailed answer explanations, JSON databases (including master.json and topic schemas), graphics, user interfaces, visual themes, logos, and custom computer code (HTML5, CSS3, JavaScript) hosted on the Platform.

1.5 "Applicable Laws" refers to all relevant statutes, acts, rules, and regulations enforced in the Republic of India, including the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Digital Personal Data Protection (DPDP) Act, 2023, the Indian Contract Act, 1872, the Copyright Act, 1957, and the Bharatiya Nyaya Sanhita (BNS), 2023 (erstwhile Indian Penal Code).

🤝 Section 2: Binding Nature of Electronic Agreement & Modifications (कानूनी समझौता और संशोधन)

2.1 Unconditional Acceptance: By accessing, loading, caching, or using any feature of BR DOT HUB, you unconditionally acknowledge that you have read, understood, and agreed to be legally bound by these Terms, along with our [Privacy Policy](/privacy), [Legal Disclaimer](/disclaimer), and [Candidate Code of Conduct](/rules). If you disagree with any clause herein, you are strictly prohibited from using the Platform and must immediately close the site and purge your browser cache. 2.2 Validity as an Electronic Record: Pursuant to Section 2(1)(t), Section 4, and Section 10A of the Information Technology Act, 2000, this document is an "Electronic Record" generated by a computer system. It does not require any physical, wet-ink, or digital cryptographic signatures to be legally valid, binding, and enforceable in a court of law.

2.3 Right to Unilateral Amendment: We reserve the unilateral right to revise, amend, add, or remove portions of these Terms at any time to reflect new platform features, exam pattern changes, or legal mandates without prior individual notice. The updated version takes effect immediately upon publication on this page. Your continued usage of the Platform constitutes your binding acceptance of the modified Terms.

⚙️ Section 3: Step-by-Step Operational Workflow of the Platform (प्लेटफ़ॉर्म की कार्यप्रणाली)

To establish clear contractual expectations between the User and BR DOT HUB, the Platform operates according to the following five-stage functional lifecycle:

Stage 1 — Client-Side Profile & Dashboard Initialization: Upon launching the Platform, our client-side application initializes a personalized dashboard in your browser. Any profile attributes you input (Name, Age, Target Exam) are stored exclusively within your device's local browser storage (LocalStorage / IndexedDB), giving you zero-latency access without mandatory server-side registration.

Stage 2 — Dynamic Study Material & Syllabus Delivery: When you navigate to our study notes or revision modules, the Platform fetches structured Markdown (.md) documents containing bilingual (Hindi & English) concepts, tables, and exam pointers for competitive exams such as Bihar Police, BSSC, Railway (RRB NTPC, Group D, ALP), and SSC (MTS, GD, CGL).

Stage 3 — Real-Time CBT Mock Test & Gamified Quiz Execution: When you start a Computer-Based Test (CBT) or 30-second live quiz, the JavaScript engine loads the question payload, activates a precision client-side countdown timer, tracks question statuses (Answered, Not Answered, Marked for Review, Not Visited), monitors window focus events for exam discipline, and computes your final net score applying exact negative marking rules (-1/3 or -1/4 as applicable).

Stage 4 — AI-Powered Academic Doubt Resolution ("Ask AI"): When you invoke the "Ask AI" assistant for a concept or question, your text query is encrypted and routed to external LLM APIs strictly for academic explanation. The response is displayed as a supplementary learning aid subject to textbook verification.

Stage 5 — Performance Analytics & Leaderboard Ranking: Upon test completion, the Platform generates a diagnostic breakdown (Accuracy %, Speed per Question, Topic Strengths/Weaknesses) stored locally on your device, and—where applicable—updates genuine human leaderboards based strictly on authentic candidate submissions.

✅ Section 4: User Eligibility, Minors & Territorial Scope (योग्यता और क्षेत्रीय सीमाएं)

4.1 Contractual Competence: Under Section 11 of the Indian Contract Act, 1872, you must be at least 18 years of age, of sound mind, and not disqualified from contracting by law to independently enter into a binding legal contract.

4.2 Access by Minors (Students Under 18): Because competitive foundation study is undertaken by younger students (aged 13 to 18), minors may access BR DOT HUB strictly under the direct supervision and prior consent of a parent or legal guardian, who agrees to be bound by these Terms on the minor's behalf. (18 वर्ष से कम आयु के छात्रों को अपने माता-पिता या अभिभावक की देखरेख में ही वेबसाइट का उपयोग करना चाहिए।)

4.3 Territorial Compliance: BR DOT HUB is engineered and operated from the Republic of India. Users accessing the Platform from outside India do so entirely at their own initiative and are solely responsible for complying with their local domestic laws, including the Foreigners Act 1946 (where applicable), GDPR, and CCPA.

🗄️ Section 5: Decentralized Local Storage Responsibilities & Profile Integrity (लोकल स्टोरेज और प्रोफ़ाइल की जिम्मेदारी)

5.1 Client-Side Data Custody: Because BR DOT HUB saves your profile, bookmarks, milestone badges, and CBT attempt records inside your browser's LocalStorage and IndexedDB rather than on a central cloud server, you are the sole custodian of your local device data. Clearing your browser data, using Incognito/Private mode without backup, formatting your phone/PC, or uninstalling the browser/PWA will permanently erase your local study history. BR DOT HUB bears zero liability for such local data loss. (आपका टेस्ट रिकॉर्ड आपके ही फोन/कंप्यूटर के ब्राउज़र में सेव रहता है। ब्राउज़र का डेटा क्लियर करने या फोन फॉर्मेट करने पर आपका पुराना टेस्ट रिकॉर्ड मिट जाएगा, जिसके लिए वेबसाइट जिम्मेदार नहीं होगी।)

5.2 Prohibition of Impersonation & Fake Profiles: You must use your genuine name or a respectful student identifier. Creating profiles that impersonate government officials, recruitment board chairmen, public figures, or BR DOT HUB administrators, or using abusive/vulgar usernames on public leaderboards, is a serious offense under Section 66C (Identity Theft) and Section 66D of the IT Act, 2000, resulting in immediate permanent banning and potential cyber-crime reporting.

💻 Section 6: CBT Engine Integrity, Anti-Cheating & Cyber Security Rules (टेस्ट इंजन और एंटी-हैकिंग नियम)

6.1 Educational Purpose & Non-Guarantee of Selection: All mock tests, quizzes, and study notes on BR DOT HUB are designed strictly for academic practice and self-evaluation. Achieving high marks or top ranks on BR DOT HUB does NOT guarantee selection, qualifying cut-offs, or employment in any real government examination. (हमारी वेबसाइट केवल आपकी तैयारी को मजबूत करने का एक माध्यम है; किसी भी सरकारी नौकरी या परीक्षा में पास होने की हम कोई गारंटी नहीं देते।)

6.2 Strict Ban on Reverse-Engineering & Score Tampering: You are strictly prohibited from attempting to compromise, hack, or manipulate the Platform's client-side or server-side architecture. Prohibited acts include:

Reverse-engineering, decompiling, or tampering with script.js, service workers, or master.json routing files;

Freezing, slowing down, or bypassing the JavaScript CBT countdown timer via browser Developer Tools (DevTools/Console);

Editing LocalStorage or IndexedDB JSON payloads to fabricate artificial 100% scores or fake leaderboard ranks;

Injecting Cross-Site Scripting (XSS), SQL/NoSQL payloads, or malicious scripts into input boxes, search bars, or feedback forms;

Using automated bots, headless browsers (Selenium, Puppeteer, Playwright), or scraping scripts to harvest questions or flood endpoints.

Any such act constitutes a punishable cyber offense under Section 43 and Section 66 of the Information Technology Act, 2000, attracting an immediate hardware/IP ban and legal prosecution. (वेबसाइट के कोड, टाइमर या स्कोर के साथ किसी भी प्रकार की छेड़छाड़ या हैकिंग करना एक गंभीर साइबर अपराध है, जिस पर सख्त कानूनी कार्रवाई की जाएगी।)

©️ Section 7: Intellectual Property Rights (IPR) & Anti-Piracy Enforcement (बौद्धिक संपदा और कॉपीराइट सुरक्षा)

7.1 Exclusive Proprietary Ownership: All original digital assets on BR DOT HUB—including compiled study notes (Markdown files), curated mock test question sets, bilingual explanations, custom JSON schemas, UI/UX layouts, brand graphics, and source code—are the exclusive intellectual property of BR DOT HUB and its founder, Niraj Kumar Yadav, protected under the Indian Copyright Act, 1957 and international copyright conventions.

7.2 Limited Personal License & Anti-Redistribution Ban: You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for your personal, non-commercial exam preparation. You are strictly forbidden from:

Copying, scraping, downloading in bulk, or converting our Markdown notes and CBT mock tests into unauthorized PDFs, e-books, or printed booklets;

Sharing, selling, broadcasting, or redistributing our study materials or question banks on Telegram channels, WhatsApp groups, YouTube videos, Instagram pages, or competing websites/apps;

Removing copyright notices, watermarks, or brand attributions from any BR DOT HUB screen or snippet.

Unauthorized commercial exploitation or piracy will trigger immediate DMCA takedowns, cyber-forensic tracing, and civil/criminal copyright infringement suits under Sections 51 and 63 of the Copyright Act, 1957. (हमारे नोट्स और मॉक टेस्ट को कॉपी करके PDF बनाना या टेलीग्राम, व्हाट्सएप, यूट्यूब व अन्य वेबसाइट पर बेचना/बाँटना पूर्णतः गैरकानूनी है।)

7.3 Open-Source & Third-Party Libraries Acknowledgment: BR DOT HUB utilizes certain open-source libraries and assets (such as Marked.js for Markdown rendering, FontAwesome for icons, and Google Fonts for typography), which remain governed by their respective open-source licenses (MIT, SIL OFL, Apache 2.0).

🤖 Section 8: Artificial Intelligence ("Ask AI") Usage Policy (AI असिस्टेंट के नियम)

8.1 Supplementary Academic Tool Only: The integrated "Ask AI" assistant is provided to help students understand complex topics, formulas, and general knowledge facts. Generative AI models can occasionally produce inaccurate or outdated statements ("AI hallucinations"). Students must always verify critical dates, constitutional articles, scientific formulas, and official exam rules against standard NCERT/reference textbooks and official government notifications. 8.2 Prohibited AI Prompts & Rate Limits: Users must not use the AI assistant to generate abusive, defamatory, sexually explicit, politically inflammatory, or illegal content, nor attempt prompt-injection attacks or automated API spamming. To ensure fair access for all students, AI queries are subject to strict rate-limiting; abuse will result in immediate suspension of AI access.

9.1 Google AdSense & Third-Party Links: BR DOT HUB displays third-party advertisements (via Google AdSense) and may include reference links to external official websites. Users must never click on advertisements fraudulently, use automated click-bots, or encourage others to click ads artificially—such activity violates Google Publisher Policies and will result in an immediate platform ban. Any interaction or purchase you make on a third-party advertiser's website is solely between you and that third party.

9.2 Future Premium Services & Strict "No Refund" Policy for Digital Goods: While BR DOT HUB provides extensive free educational resources, we reserve the right to introduce optional premium mock test series, downloadable digital study packs, or high-tier AI features. In accordance with consumer e-commerce norms for instant-access digital content, once any digital study material, test pass, or subscription is unlocked, accessed, or downloaded, the transaction is 100% final, non-refundable, and non-transferable. Initiating false bank chargebacks after consuming digital services will result in permanent expulsion and legal recovery proceedings. (डिजिटल अध्ययन सामग्री या प्रीमियम टेस्ट अनलॉक होने के बाद किसी भी परिस्थिति में शुल्क वापस (Refund) नहीं किया जाएगा।)

🏛️ Section 10: Absolute Non-Governmental Affiliation Declaration (गैर-सरकारी संस्थान घोषणा)

10.1 Independent Private Educational Initiative: BR DOT HUB is an independent private educational platform created by Niraj Kumar Yadav. We have NO official affiliation, partnership, authorization, or endorsement from the Government of India, the Government of Bihar, or any examination board including BSSC, BPSSC, CSBC (Bihar Police), RRB (Railway Recruitment Boards), SSC (Staff Selection Commission), or UPSC. Exam names and syllabus references are used strictly under nominative fair use to indicate the target examination for students.

📩 Section 11: Mandatory 21-Day Notice-and-Takedown Condition Precedent (कॉपीराइट विवाद निवारण नियम)

11.1 Mandatory Prior Written Notice: BR DOT HUB respects intellectual property rights and operates under the "Fair Dealing" educational provisions of Section 52(1)(i) of the Indian Copyright Act, 1957 and Safe Harbor intermediary protections under Section 79 of the IT Act, 2000. If any copyright holder, publisher, or entity believes that any material on BR DOT HUB infringes their copyright, sending a formal written Takedown Notice to adminbrdothub@gmail.com (containing the exact URL, proof of original ownership, and authorized contact details) is a mandatory condition precedent before initiating any civil, criminal, or administrative legal action. BR DOT HUB shall have a cure window of 21 working days from receipt of a valid notice to investigate and remove the disputed material. (किसी भी कॉपीराइट शिकायत के मामले में कानूनी कार्रवाई से पहले हमें आधिकारिक ईमेल भेजना और सामग्री हटाने के लिए 21 कार्य दिवसों का समय देना अनिवार्य है।)

🛡️ Section 12: Limitation of Liability, Indemnification & Force Majeure (देयता की सीमा और क्षतिपूर्ति)

12.1 "As-Is" and "As-Available" Provision: The Platform and all its contents are provided strictly on an "As-Is" and "As-Available" basis without warranties of any kind, whether express or implied. We do not warrant that the Platform will be 100% uninterrupted, error-free, or immune from typographical errors in questions/notes.

12.2 Exclusion of Consequential Damages: Under no circumstances shall BR DOT HUB, its founder Niraj Kumar, or its contributors be liable for any direct, indirect, incidental, consequential, or special damages—including exam failure, loss of employment opportunity, loss of local browser data, or technical downtime—arising out of your use or inability to use the Platform.

12.3 User Indemnification: You agree to defend, indemnify, and hold harmless BR DOT HUB and its founder from any claims, liabilities, damages, legal fees, or demands arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party rights.

12.4 Force Majeure: BR DOT HUB shall not be liable for any service interruption or delay caused by events beyond our reasonable control, including natural disasters, government internet shutdowns, telecom failures, cyber-warfare, DDoS attacks, or third-party cloud/API outages.

⚖️ Section 13: Class Action Waiver, Severability & Governing Jurisdiction (न्यायक्षेत्र और विवाद समाधान)

13.1 Class Action Waiver: Any dispute or claim against BR DOT HUB must be brought strictly in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

13.2 Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full legal force and effect.

13.3 Governing Law & Exclusive Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, controversy, or claim arising out of or relating to BR DOT HUB shall be subject to the strict and exclusive jurisdiction of the competent courts located in Biharsharif / Nalanda, Bihar, India. (BR DOT HUB से जुड़े किसी भी कानूनी विवाद की सुनवाई का अधिकार क्षेत्र केवल बिहारशरीफ / नालंदा, बिहार के न्यायालयों के पास होगा।)
